(a) All samples used in your works are either your own original production, genuine copyright-free samples or are used with all applicable licenses and rights granted. Furthermore you must be able to provide proof that you have the consent of the copyright holder to use any and all samples upon request.

(b) You have full right and power to enter into and perform this agreement, and have secured all third party consents necessary to enter into this agreement.

(c) The Content does not and will not infringe on any third party’s copyright, patent, trademark, trade secret or other proprietary rights, rights of publicity or privacy, or moral rights.

(d) The Content does not and will not violate any law, statute, ordinance or regulation.

(e) The Content is not and will not be defamatory, trade libelous, pornographic or obscene.

(f) The Content does not and will not contain any viruses or other programming routines that detrimentally interfere with computer systems or data.

(g) All factual assertions that you have made and will make to us are true and complete. You agree to indemnify and hold us and our customers harmless from any and all damages and costs, including reasonable attorney’s fees, arising out of or related to your breach of the representations and warranties described in this section. You agree to execute and deliver documents to us, upon our reasonable request, that evidence or effectuate our rights under this agreement.

Members of the Musicv2.com website have the sole responsibility and liability for the data stored on the Musicv2.com servers. Musicv2.com encourages all members to archive and regularly backup their files; User bears full responsibility for archiving their data and sole liability for any lost or irrecoverable data. Musicv2.com can not and will not be held liable for lost data. Users agree to maintain their data in compliance with their legal obligations.

Musicv2.com is not a music distributer but rather a web hosting service provider. More specifically we are defined as an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). The musicians and dj's who use the Musicv2.com website have represented that they have full rights to submit content to the Musicv2.com website.

While Musicv2.com is not in a legal position to determine who has the prevailing claim to use any particular content or name posted to the web site, we are 100% compliant with DMCA policies and procedures.

When notified of such abuse, Musicv2.com will immediately disable access to disputed material.

All artist pages on the Musicv2.com website are intended for the use of individual artists or bands. The use of a Musicv2.com artist page to host multiple artists without the express permission of Musicv2.com will result in suspension of said account and possible termination. If you operate a record label or are part of a dj collective you may inquire about our special crew/record label rates by contacting us at: musicv2@musicv2.com.

The Musicv2.com Artist Subscription Service was designed and created to be used in a legal manor only. Abuse or misuse of the system may result in account termination and legal action. The Artist Subscription Service technology is provided on a good faith basis meaning that the technology is provided to all. We expect all artists to act in a responsible and legal manor when it comes to utilizing this technology.

As a visitor, by becoming a subscriber to any particular artist you understand that the original copyright holder(s) retains all applicable rights under international law.

All Musicv2.com sales are final. In some special cases the administrators of Musicv2.com may choose to issue refunds based on our sole discretion. Accounts that are suspended or cancelled due to a violation of our Terms and Conditions will not be issued a refund of any kind.

Charge-backs and bank reversals are grounds for immediate account suspension or termination.

If you feel that your situation warrants a refund, please feel free to contact us at musicv2@musicv2.com to have your situation reviewed.

To cancel a paid Musicv2.com account and prevent further billing, a cancellation request must be submitted at least 7 days before the next billing cycle is scheduled to take place.

If a cancellation request is made after billing occurs, a refund will not be issued although the Musicv2.com account in question will remain active and available for the remainder of the period for which payment has been made.

It is the users responsibility to manage the billing associated with their account and Musicv2.com will and can not be held liable for any losses or penalties associated with recurring billing that is not properly canceled prior to the established renewal date.

Lifetime memberships are defined by the Musicv2.com website as follows:

Lifetime memberships will remain active and available for the entire duration that the Musicv2.com website continues to operate under the current ownership. In the case that Musicv2 were sold, the current owners of Musicv2.com cannot guarantee that Lifetime Memberships will be honored by new ownership.

Likewise if the Musicv2.com website were to cease to exist, all obligations to our users in regards to membership durations whether Lifetime or otherwise would terminate affective the last day of operation.

By agreeing to and accepting the above Terms of Service you hereby release Musicv2.com, it's Partners, Affiliates, Investors, and any third party business that has dealings with Musicv2.com from any damages or liabilities that may arise from use of this Web site. You understand that Musicv2.com presents no warranties or promises of any sort other than those presented in our Terms of Service. Musicv2.com reserves the right to refuse service to any person at anytime depending on our sole discretion.

From time to time Musicv2.com may modify these Terms and Conditions in its sole discretion. When such modification is made, Musicv2.com will post a revised version of these Terms and Conditions on the Website. Modifications will be effective when they are posted. Musicv2.com is not required to provide you with notification that any such modification has been made. It is your responsibility to review these Terms and Conditions from time to time to be aware of any such modifications.

If there is any dispute about or involving the Musicv2.com Services, you agree that the dispute shall be governed by the laws of the Province of Saskatchewan, Canada, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the Provincial and Federal courts of Canada located in the Province of Saskatchewan, City of Saskatoon.

BY COMPLETING THE ARTIST SIGN-UP PROCESS YOU SIGNIFY THAT YOU HAVE BOTH READ AND AGREE TO THE ABOVE STATED TERMS OF SERVICE.
